Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Nomadify (“Nomadify,” “we,” “us,” or “our”). They govern your use of the Nomadify iOS app (bundle ID app.nomadify.ios) and the website at nomadify.app (together, the “Service”).

1. Introduction

Nomadify is a community for travelers. The Service helps you find other travelers heading to the same places, create or join real-world activities and meetups, chat in-app, and get AI-generated activity ideas to spark plans. Nomadify is not a dating app and is not designed for romantic or sexual matchmaking.

By creating an account or otherwise using the Service, you confirm that you've read and agree to these Terms, our Privacy Policy, and our Community Guidelines. If you don't agree, don't use the Service.

2. Account eligibility and your responsibilities

You must be at least 18 years old to create an account or use the Service. By using Nomadify, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms in the country where you live.

You agree to:

  • Provide accurate, current, and truthful information when you register and keep it up to date.
  • Use your real name and a recognisable photo of yourself, and maintain only one account.
  • Keep your phone, Apple ID, and any associated credentials secure, and notify us immediately at com3run@gmail.com if you suspect unauthorized access to your account.
  • Take responsibility for everything that happens under your account.
  • Comply with all applicable laws — including local laws — when using the Service and when meeting other members in person.

3. Content on Nomadify

The Service contains three kinds of content. Different rules apply to each.

3.1 Your content

“Your content” means anything you post, upload, or transmit through the Service — your profile, photos, messages, activities, comments, and reactions. You are solely responsible for your content. You must have the rights to share it, and it must comply with these Terms and our Community Guidelines.

3.2 Member content

“Member content” means content posted by other Nomadify users. We don't pre-screen member content. Opinions, recommendations, activity descriptions, and AI-generated suggestions surfaced through other members are not endorsed by Nomadify. Use your own judgment.

3.3 Our content

“Our content” means everything Nomadify itself provides — the app and website, software, design, branding, copy, the “Nomadify” name and logo, and any AI-generated suggestions served through our systems. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use our content solely to use the Service as intended. We retain all rights not expressly granted.

4. Inappropriate content, misconduct, and reporting

We have zero tolerance for objectionable content and abusive behaviour on Nomadify. The following — and anything similar — is not allowed:

  • Harassment, threats, hate speech, or content that targets people based on who they are.
  • Sexual, pornographic, or sexually exploitative content of any kind. Anything involving minors is reported to law enforcement.
  • Violence, graphic content, self-harm content, or promotion of weapons.
  • Fraud, scams, romance scams, phishing, requests for money or financial information, MLM, and commercial spam.
  • Illegal activity, including coordination of illegal substances or services.
  • Impersonation, fake profiles, bots, scraping, and ban evasion.

Anyone can report objectionable content or an abusive user from inside the app or by emailing com3run@gmail.com. We aim to review every report and, when a violation is confirmed, remove the offending content and eject the violating user within 24 hours of the report. Severe violations result in an immediate permanent ban without a prior warning. The full rules live in our Community Guidelines.

5. Privacy

Your use of the Service is also subject to our Privacy Policy, which explains what data we collect, how we use it, who we share it with, and how you can exercise your rights. By using Nomadify, you agree to those practices.

6. Rights you grant Nomadify

You keep ownership of your content. To run the Service, we need permission to host, store, and show that content to other travelers. So, by posting content on Nomadify, you grant Nomadify a worldwide, non-exclusive, royalty-free, sublicensable, transferable licence to host, store, cache, copy, reproduce, adapt (for example, to resize images or create thumbnails), publish, translate, publicly display, and distribute your content, solely for the purpose of operating, providing, improving, marketing, and securing the Service.

This licence ends when you remove your content or delete your account, except for: (a) copies that have been shared with others who have not deleted them; (b) reasonable backups; and (c) where we need to retain content to comply with legal obligations or enforce these Terms.

You also grant other Nomadify members a non-commercial, personal-use licence to view your public profile and content within the Service. You may not scrape, copy, or republish other members' content outside Nomadify.

7. Auto-renewing subscriptions (Nomadify Plus)

Nomadify Plus is an auto-renewable in-app subscription that unlocks premium features. Current pricing:

  • Weekly: $4.99 USD / week
  • Monthly: $14.99 USD / month
  • Yearly: $59.99 USD / year

Prices shown in the App Store at the moment of purchase apply, and Apple may adjust them for local currency, taxes, and regional App Store rules. Nomadify Plus is billed by Apple through your Apple App Store account at confirmation of purchase.

Your subscription automatically renews at the end of each period at the same price, unless you cancel at least 24 hours before the current period ends. Your Apple account is charged for renewal within 24 hours prior to the end of the current period.

You can manage or cancel your subscription anytime on your iPhone in Settings → your Apple ID → Subscriptions. Cancelling stops the next renewal but doesn't refund the current period. Refunds are handled by Apple under their App Store policies — request one at reportaproblem.apple.com. Nomadify can't cancel or refund an App Store subscription on your behalf. 8. Account termination

You can stop using Nomadify at any time and delete your account from inside the app or by emailing com3run@gmail.com. Deleting your account ends your right to use the Service and is generally irreversible — see the Privacy Policy for what happens to your data.

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms or our Community Guidelines, if your conduct puts other members at risk, if continued provision of the Service to you exposes Nomadify to legal or regulatory risk, or if we stop offering the Service in your region.

Cancelling Nomadify Plus through the App Store stops the next renewal but doesn't delete your account. Deleting your account doesn't cancel an App Store subscription — manage that separately in your Apple account.

9. No background or identity checks

Nomadify does not conduct criminal background checks, identity verification, or screening of any kind on its members. Profile photos, names, ages, bios, and any other information shown about other members is content they have provided themselves. We do not verify it.

You are solely responsible for your interactions with other members, both inside the Service and when you meet in person. Always exercise caution and good judgment. Read our Safety Tips before your first meetup.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, Nomadify disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted, secure, accurate, complete, or error-free operation.

Without limiting the above, Nomadify makes no warranty that: (a) members are who they say they are or will behave a certain way; (b) activities, venues, AI suggestions, or other content will be safe, accurate, lawful, or available; (c) the Service will meet your requirements; or (d) defects in the Service will be corrected.

11. Limitation of liability

To the fullest extent permitted by law, in no event will Nomadify, its affiliates, officers, employees, agents, suppliers, or licensors be liable for:

  • Any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, data, goodwill, or other intangible losses;
  • Any conduct or content of any other member or third party on the Service, including any defamatory, offensive, illegal, or harmful content;
  • Any harm — physical, emotional, financial, or otherwise — that results from your interactions with other members, online or in person, or from your participation in any activity organised through the Service;
  • Any unauthorized access to or alteration of your transmissions or content.

To the maximum extent permitted by law, Nomadify's total aggregate liability arising out of or relating to these Terms or the Service is limited to the greater of (a) USD $100 or (b) the amount you paid Nomadify Plus in the twelve (12) months before the event giving rise to the liability. Some jurisdictions don't allow certain limitations of liability, so some of these may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Nomadify and its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service; (b) your content; (c) your breach of these Terms, our Community Guidelines, or any applicable law; or (d) your interactions with, or harm caused to, any other member or third party — including in-person meetups organised through the Service.

13. Dispute resolution and governing law

We hope to resolve any concern quickly and informally. Before starting any formal action, please email com3run@gmail.com with a description of your concern so we can try to sort it out directly.

Except where prohibited by your local law, these Terms and any dispute arising out of or related to them or the Service are governed by the laws applicable to where Nomadify is established, without regard to conflict-of-laws principles. The courts of that jurisdiction will have exclusive jurisdiction over such disputes, except that you may bring claims in your country of residence where local consumer protection laws require it.

Nothing in this section limits any non-waivable rights you have as a consumer under the law of your country of residence.

14. Changes to these terms

We may update these Terms from time to time as Nomadify evolves or as the law requires. When we make changes, we'll update the “Last updated” date above. For material changes, we'll also notify you in the app or by another reasonable method before they take effect.

Continuing to use the Service after changes take effect means you accept the updated Terms. If you don't agree, your remedy is to stop using the Service and delete your account.

15. Acceptance

By creating an account, subscribing to Nomadify Plus, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, and our Community Guidelines.
